Terms of Service

By creating a ConvoCrew account or using the ConvoCrew platform (“Service”), you (“Customer”) agree to these Terms of Service (“Terms”) with ConvoCrew (“we”, “us”). If you are accepting on behalf of a company, you represent that you have authority to bind that company.

ConvoCrew is a SaaS platform that enables businesses to connect their WhatsApp Business phone number to a shared inbox, deploy an AI assistant (powered by OpenAI), manage customer conversations, and set up automation via the WhatsApp Cloud API.

The Service is provided on a best-effort basis. We do not guarantee specific uptime SLAs unless stated in a separate written agreement.

• You must provide accurate registration information and keep it up to date.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old or the age of majority in your jurisdiction.
• You must not share login credentials or allow unauthorised access to your account.
• Notify us immediately at info+convocrew@anarchylabs.in if you believe your account has been compromised.

ConvoCrew operates on the WhatsApp Cloud API. Your use of the Service is subject to and must comply with:

• WhatsApp Business Policy
• Meta Advertising Standards
• Meta Platform Terms

You must obtain valid opt-in consent from each end user before initiating any WhatsApp conversation. You are solely responsible for ensuring your messaging complies with Meta’s policies. Violations may result in Meta restricting or removing your WhatsApp Business Account, independent of ConvoCrew.

You must not use ConvoCrew to:

• Send unsolicited messages (spam) or bulk promotional messages without prior opt-in consent
• Transmit illegal, harmful, threatening, abusive, defamatory, or obscene content
• Impersonate any person, business, or entity
• Send messages that violate applicable consumer protection laws
• Use the AI assistant to generate false, misleading, or deceptive content that could harm end users
• Attempt to circumvent Meta’s messaging limits or quality enforcement
• Reverse engineer, resell, or sublicense the Service without our written consent
• Use the Service in any way that violates applicable law

We reserve the right to suspend or terminate accounts that violate these rules, without notice where immediate action is required.

ConvoCrew’s AI assistant uses OpenAI’s models to generate responses. By enabling AI for a conversation, you acknowledge:

• AI responses are generated automatically and may contain errors, inaccuracies, or hallucinations.
• You are responsible for reviewing AI output and ensuring it is appropriate for your customers.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated responses.
• You must not represent AI responses as having been written by a human where doing so would mislead your customers.

Message content processed by AI is subject to OpenAI’s Privacy Policy. OpenAI does not use API data to train models.

You retain ownership of all content you upload to ConvoCrew (knowledge base articles, business information, conversation data). By uploading content, you grant ConvoCrew a limited, non-exclusive licence to process and store that content solely to provide the Service.

You are responsible for ensuring you have the right to upload and use any content you provide.

Paid plans are billed in advance on a monthly or annual cycle. All fees are non-refundable except as required by law or expressly stated in our refund policy. We reserve the right to change pricing with 30 days’ notice. Continued use after a price change constitutes acceptance of the new pricing.

Failure to pay may result in suspension of your account. Accounts suspended for non-payment for more than 30 days may be terminated and data deleted.

ConvoCrew and all associated software, designs, trademarks, and content are owned by or licensed to us. Nothing in these Terms grants you any right to use our intellectual property other than to use the Service as permitted.

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. To the extent you process personal data of EU/EEA residents through ConvoCrew, you act as data controller and ConvoCrew acts as data processor. A Data Processing Agreement is available on request at info+convocrew@anarchylabs.in.

Each party may have access to the other’s confidential information. Both parties agree to keep such information confidential and not to disclose it to third parties without prior written consent, except as required by law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, uninterrupted, or that messages will be delivered. WhatsApp message delivery is subject to Meta’s infrastructure, over which we have no control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONVOCREW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless ConvoCrew and its officers, directors, employees, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any third-party rights, or your violation of Meta’s or WhatsApp’s policies.

These Terms remain in effect while you use the Service. Either party may terminate at any time. We may suspend or terminate your account immediately if you violate these Terms, violate Meta’s policies, or if required by law.

On termination, your right to use the Service ends. We will delete your data within 30 days of account closure (subject to our retention obligations in the Privacy Policy). You may export your data before closure.

We may update these Terms with 14 days’ notice for material changes (via email or in-app notice). Continued use of the Service after the notice period constitutes acceptance of the updated Terms. For non-material changes (e.g. clarifications), we may update without notice.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India. If you are a consumer in the EU/EEA, you may also have rights under the consumer protection laws of your country.
